This appeal comes by virtue of the Onitsha High Court Judgement in respect of the estate of Late Francis Okwudili Chukwuma who died intestate. It was bought by the respondents (the four sons of the deceased) against the 1st appellant the surviving wife of the deceased and the 5th respondent seeking amongst others, a partition at their late father's estate according to the native law and Custom. Respondents called five witnesses the appellant testified and also called one witness.
Trial Judge in Judgement revoked the letter of administration earlier issued; that the 1st defendant is entitled to her interest as the lawful wife of the deceased and or daughter is also entitled to her interest as the only daughter of the deceased for life or until she married whichever is earlier; The 1st son and 4th son were to apply for letters of administration to ensure equitable administration of the estate. Dissatisfied, appellant appealed against the last ruling.
